"What's On" Event Terms (v1.0)

THIS AGREEMENT is made on the date of submission by the Organiser.

BETWEEN:

​

(1) Care Finder Assist Ltd, a company registered in England and Wales under company number 16561214, whose registered office is at Hardwick House, 2 Agricultural Hall Plain, Norwich, Norfolk, NR1 3FS ("CFA"); and (2) The individual or legal entity submitting an event for publication ("the Organiser").

RECITALS (A) CFA operates a specific section of its website known as The Care Catalogue, which includes a page dedicated to listing local events (the "'What's On' Page"). (B) The Organiser wishes to list an event on the 'What's On' Page. (C) CFA agrees to consider publishing the listing on a non-guaranteed, free-of-charge basis, subject strictly to the terms of this Agreement.

 

IT IS HEREBY AGREED as follows:

 

1. DEFINITIONS AND INTERPRETATION

  • "Agreement": These Terms and Conditions for "What's On" Event Listings.

  • "Business as Usual Activity": Routine commercial operations, standard opening hours, sales promotions, or recruitment drives.

  • "Event": A specific, time-limited occurrence, gathering, or activity submitted by the Organiser.

  • "Listing": The text, images, and data submitted by the Organiser for publication.

 

2. ACCEPTANCE OF TERMS

2.1. By submitting an Event for publication, the Organiser is deemed to have irrevocably accepted the terms of this Agreement.

 

3. ELIGIBILITY CRITERIA

3.1. Genuine Public Events Only: To be eligible for a Listing, the Event must be a genuine, specific occasion (e.g., a fete, coffee morning, seminar, performance, or open day) that is open to members of the public. 3.2. Exclusion of "Business as Usual": CFA will not publish Listings that constitute "Business as Usual Activity." General notices regarding a provider's availability, standard visiting hours, or general recruitment ads are strictly prohibited on this page. 3.3. Frequency Cap: The Organiser is permitted to submit a maximum of two (2) Events per calendar week. CFA reserves the right to reject any submissions exceeding this cap without notice.

 

4. NATURE OF SERVICE (FREE LISTING)

4.1. Discretionary Service: The publication of an Event is a free service provided at CFA's absolute discretion. CFA provides no guarantee that any submitted Event will be published. 4.2. Right to Refuse or Remove: CFA reserves the absolute right to refuse, edit, suspend, or permanently remove any Listing at any time, for any reason, without prior notice or explanation. 4.3. No Liability for Omission: CFA shall not be liable for any loss or damage arising from a failure to publish an Event or for any errors in the published Listing.

 

5. ORGANISER'S WARRANTIES

5.1. The Organiser warrants and represents that: (a) All information provided (including dates, times, venues, and costs) is truthful, accurate, and not misleading. (b) The Event is a genuine occurrence and is not a "Business as Usual" promotion. (c) The Organiser holds all necessary insurance (including Public Liability Insurance), permits, and licenses required to host the Event safely and legally. (d) The Organiser holds the copyright (or a valid license) for all images and text submitted.

 

6. NO ENDORSEMENT AND DISCLAIMER

6.1. "Noticeboard" Status: CFA acts solely as a passive conduit ("noticeboard") for information provided by the Organiser. 6.2. No Endorsement: The publication of a Listing does not constitute an endorsement, recommendation, or vetting of the Event or the Organiser by CFA. 6.3. User Diligence: CFA does not verify the safety, legality, or quality of the Events listed. It is the sole responsibility of the Organiser to ensure the Event is safe and compliant with all laws.

 

7. INTELLECTUAL PROPERTY

7.1. The Organiser grants CFA a non-exclusive, worldwide, royalty-free license to use, reproduce, and format the content submitted for the purpose of displaying the Listing on the website and associated social media channels.

 

8. INDEMNITY AND LIABILITY

8.1. Indemnity: The Organiser shall indemnify Care Finder Assist Ltd against all liabilities, costs, and legal fees arising from the content of the Listing, the running of the Event itself, or any breach of this Agreement. 8.2. Limitation of Liability: As this is a free service, CFA’s total liability to the Organiser for any claim arising out of this Agreement shall be limited to £0 (zero pounds).

 

9. GENERAL PROVISIONS

9.1. Data Protection: Use of personal data is governed by our Privacy Policy and the UK GDPR. 9.2. Governing Law: This Agreement is governed by the laws of England and Wales.
